scheme is designed <\/span><span style=\"font-weight: 400\">for <\/span><span style=\"font-weight: 400\">\u201cInformation Society Services (ISS) likely to be accessed by Children\u201d. It is designed <\/span><span style=\"font-weight: 400\">for data processors, controllers and joint controllers (Auditees) <\/span><span style=\"font-weight: 400\">of any size that process Personal Data of Children.\u00a0 It covers <\/span><span style=\"font-weight: 400\">\u00a0apps, programs, connected toys and devices, search engines, social media platforms, streaming services, online games, news or educational websites and websites offering other goods or services to users over the internet. It is not restricted to services specifically directed at children. <\/span><span style=\"font-weight: 400\">Auditors may provide the scheme, as agreed by contract with the Auditee, for one or more data processing systems, including all algorithmic systems, artificial intelligence, or autonomous systems when Personal Data of Children is involved.\u00a0\u00a0<\/span><\/p><p><span style=\"font-weight: 400\">There are a few selected systems that are out of scope for ForHumanity\u2019s Children\u2019s Code Certification Scheme as they are outside the scope of the Children\u2019s Code (CC) itself such as:<\/span><\/p><ol><li><span style=\"font-weight: 400\">Counselling or preventive services,\u00a0<\/span><\/li><li><span style=\"font-weight: 400\">Online services dedicated to law enforcement purposes<\/span><\/li><li><span style=\"font-weight: 400\">General Broadcast Services<\/span><\/li><li><span style=\"font-weight: 400\">\u201cReal world \u201c business information with no additional services<\/span><\/li><li><span style=\"font-weight: 400\">Voice telephony or Voice Over Internet Protocol<\/span><\/li><li><span style=\"font-weight: 400\">The service monitors or engages no UK users<\/span><\/li><\/ol>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-be01238 elementor-widget elementor-widget-menu-anchor\" data-id=\"be01238\" data-element_type=\"widget\" data-widget_type=\"menu-anchor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div id=\"TargetofEvaluation\" class=\"elementor-menu-anchor\"><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7986f10 elementor-widget elementor-widget-heading\" data-id=\"7986f10\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h5 class=\"elementor-heading-title elementor-size-default\">Target of Evaluation<\/h5>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-487ac1c elementor-widget elementor-widget-text-editor\" data-id=\"487ac1c\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400\">The Auditee determines the system(s) to which the Auditor will apply the scheme and memorialises this agreement via contract. The Target(s) of Evaluation (ToE) shall be defined within the contract between the auditor and the organisation (auditee).\u00a0 The Auditee will contract for any or all data controller\/joint-controller\/processor ToEs that are in scope, including, but not limited to algorithmic systems, artificial intelligence or autonomous systems that include Personal Data.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400\">The Auditor will perform an audit to the breadth and scope upon the ToE determined by the contract with the Auditee.\u00a0 The Auditee bears the responsibility of ensuring that all necessary systems undergo an Audit.\u00a0 The contract must specify one of the following:<\/span><\/p><ol><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">For an individual system certification \u2014 The Auditee shall identify the ToE by name\/identifier, specifically noting the boundaries of the systems.\u00a0 Associated systems or adjacent processing must be clearly delineated as \u201cin scope\u201d or \u201cout of scope\u201d by the contract and have defined beginnings and endings. In scope functions can include Data Processors acting on behalf of a data controller.\u00a0<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Multiple named systems, with the same criteria as #1 for each system or the sum of the combined systems, where the Auditee must delineate the \u201cbeginnings and ends\u201d.\u00a0<\/span><\/li><\/ol><p>\u00a0<\/p><p><span style=\"font-weight: 400\">A firm can demonstrate compliance with the Children\u2019s Code through an official or recognised Children\u2019s Code Certification scheme.\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400\">There are certain audit criteria that apply only to Data Controllers. As a result, an organisation that functions solely as a Data Processor will be unable to comply with audit criteria specified for Data Controllers. This will not prevent them from achieving certification.\u00a0 Data Processors will not need to comply with criteria that applies only to Data Controllers and marked \u201cController-only\u201d.\u00a0 A Data Controller or Joint-Controller must be compliant with <\/span><i><span style=\"font-weight: 400\">all<\/span><\/i><span style=\"font-weight: 400\"> criteria for certification.<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400\">Compliance with the Children\u2019s Code, and thus a Children\u2019s Code Certification Scheme, implies that the organisation is engaging in some form of data processing that includes the use of Children\u2019s Personal Data or Special Category Data from Children. The ToE should be identified transparently and willingly by the organisation in order to achieve compliance with the Children&#8217;s Code.\u00a0\u00a0<\/span><\/p><p>\u00a0<\/p><p><span style=\"font-weight: 400\">This certification scheme is a modular enhancement to the UK GDPR Certification scheme.\u00a0 An organisation <\/span><b>shall not<\/b><span style=\"font-weight: 400\"> receive Children\u2019s code certification without also having achieved a UK GDPR certification. This scheme as designed requires separate UK GDPR for foundational areas of compliance such as\u00a0 principle of Data Minimisation, which exists both in UK GDPR and the Children\u2019s Code.<\/span><\/p><p><br \/><span style=\"font-weight: 400\">For this reason, <\/span><span style=\"font-weight: 400\">this certification scheme focuses on assuring compliance with the interrelated laws and associated Codes that underpin children\u2019s data control, processing and privacy.
